Which Uber or Lyft Insurance Policy Applies to Your Accident

Uber and Lyft each maintain insurance policies that shift depending on what the driver was doing when the crash occurred. This is one of the first questions we investigate in any rideshare accident claim because it determines the maximum coverage available.

App Off
If the driver wasn’t logged into the rideshare app, no Uber or Lyft coverage applies. Only the driver’s personal auto insurance is available.

App On, Waiting for a Ride Request
During this phase, Uber and Lyft each provide contingent liability coverage of $50,000 per person, $100,000 per accident, and $25,000 for property damage, but only if the driver’s personal policy doesn’t cover the loss.

Ride Accepted or Passenger on Board
Once a driver has accepted a trip or has a passenger in the vehicle, both Uber and Lyft carry $1 million in third-party liability coverage. Michigan law also requires rideshare drivers to maintain valid no-fault Personal Injury Protection (PIP) coverage alongside the company policy.

Michigan No-Fault Insurance & Rideshare Crashes in Ludington

Michigan’s no-fault system means injured parties are generally entitled to PIP benefits from their own insurer regardless of who caused the accident. PIP covers medical bills, lost wages, and replacement services for tasks you can no longer perform. In rideshare accidents, the priority order for PIP coverage typically starts with the injured person’s own insurer, then a resident relative’s insurer, and only then the Uber or Lyft policy. The rideshare company’s PIP applies last if no other coverage is available.

To pursue pain and suffering compensation through a third-party fault claim, Michigan law requires that your injuries meet a threshold: death, serious impairment of body function, or permanent serious disfigurement. Michigan’s 2019 no-fault reform allowed drivers to select lower PIP coverage levels, which can limit available benefits and make fault-based claims more significant in some cases. Under MCL 600.5805, personal injury lawsuits must generally be filed within three years of the accident date, so timing matters.

Who Can File a Rideshare Accident Claim

You don’t have to be a passenger in the rideshare vehicle to have a claim. A wide range of people injured in these crashes may have grounds to pursue compensation.

Potential claimants include:

  • Passengers riding in an Uber or Lyft at the time of the crash
  • Occupants of other vehicles involved in the collision
  • Pedestrians or cyclists struck by a rideshare driver
  • Surviving family members pursuing a wrongful death claim

Compensable losses can include medical expenses, lost wages, loss of earning capacity, property damage, pain and suffering, emotional distress, disability, disfigurement, and loss of enjoyment of life. Wrongful death claims may also cover funeral costs, lost financial support, and loss of companionship. Michigan doesn’t cap pain and suffering damages in rideshare accident cases.

Why Ludington Clients Work with Miller Embury PLLC

Uber, Lyft, and their insurers employ legal teams whose job is to minimize payouts. Having our attorneys in your corner, attorneys who know how these cases work and who are prepared to take them to court, can change the dynamic of that negotiation.

We operate a physical office in Ludington. For clients in Mason County and the surrounding area, that means working with attorneys who litigate locally, including in the 51st Circuit Court in Ludington, rather than coordinating remotely with a firm that has no presence here. Founding attorneys Nathan P. Miller, ESQ. and Ryann S. Embury, ESQ. are personally involved in client cases from start to finish, not just at sign-up. When insurers undervalue a claim, we can go to court. Not every personal injury firm does.

Our representation is on contingency: no legal fees unless we recover compensation for you.
